SimMiles - Terms of Use

SECTION 1: MEMBERSHIP TERMS.

1. Virtual Airlines who's names derive from real world Airlines must keep their online operations as close to their real world counterparts as possible. This includes (but is not limited to) fleet, routes, scheduling and callsigns.
2. Virtual Airlines based on real world Airlines may, on rare occasions deviate from para 1 only if it does not harm another real world based VA's operations and/or market share and by first obtaining prior written permission from the SimMiles CEO or any other persons duly authorised on his behalf.
3. SimMiles accepts membership from all real world based virtual airlines however, will not host more than 1 Virtual Airline which is based on the same real world counterpart. For example, SimMiles will never serve 2 or more Virtual Airlines which are based on British Airways.
4. In order for a fictional Virtual Airline to become a member of SimMiles. The VA must have been in operation for at least 3 months and have 10 regularly active members. Evidence of these 2 requirements may need to be demonstrated at the request of SimMiles for verification purposes.
5. Any fictional VA who is to become a member of SimMiles must have a unique ICAO code which does not conflict with any other VA on the SimMiles system nor that of any real world airlines who may in the future have a virtual hosted by SimMiles. Each VA's ICAO is used to identify that particular VA, both for SimMiles staff and the database to successfully host the VA and its operations.
6. Once granted membership a Virtual Airline must remain active with at least one flight per week from the time operations start. Should a VA fail to remain active over a period of fourteen (14) days, SimMiles reserves the right to cancel the account and administratively remove the CEO from the VA and his/her staff without refund.
7. Where SimMiles has designed and created a website along with hosting for a Virtual Airline, the website shall - at all times - remain property of SimMiles.
8. Any property of SimMiles including (but not limited to) servers and email addresses, may NOT be used for any illegal activities. This applies to SimMiles Staff, VA CEO's and also VA Staff members.
9. Where a Virtual Airline has lost Virtual Funds or in most cases spent too much, SimMiles will not grant further virtual capital to the VA. In the event that it occurs as a result of a SimMiles error then SimMiles will always re-credit the virtual airline their funds.
10. All Virtual Airlines must note that they are responsible for Pilots who fly for their Virtual Airline. At no time will SimMiles enter into any discussion with a Pilot when it comes to the Virtual Airline. Any authorisations for changes to the VA or requests will only be adhered to if such requests are made by the CEO of that Virtual Airline. If a VA's CEO wishes to appoint someone to act on their behalf for a temporary period then that assigned individual must hold a staff position with the Virtual Airline and notification sent to SimMiles from the VA's CEO and that person only.
11. You must maintain a an ongoing subscription to maintain your Virtual Airline account. Your account is automatically cancelled if you cancel or suspend your subscription regardless of the amount of time remaining on the account.

Section 2: Commitment From SimMiles

1. The SimMiles Staff and Volunteers are here to provide and assist all Virtual Airlines with the means necessary to maintain the successful execution of the VA's operations.
2. While we aim to provide a service 24 hours a day 7 days a week, times may arise when this is not available. Therefore, all requests from Virtual Airlines must be made via email to your support representative or through tickets made in the admin section of your Virtual Airlines account.
3. All requests shall be completed within 48 hours of receipt and if the rare occasion arises that this cannot be done, notification will be sent to the Virtual Airlines CEO. All requests must be sent directly to your support representative in order to ensure that this turnaround time can be achieved effectively. Requests to higher level management such as SimMiles Crew Leaders or the CEO and his executive team should be avoided as the 48 hour turnaround time cannot be guaranteed due to their own Regions and work load. Therefore requests made to those other than your designated support representative will only execute requests for VA's that are not their responsibility as a last priority. This further ensures the effective smooth running of SimMiles as a whole.
4. SimMiles Staff and Volunteering positions are considered to be positions of trust where there is a balance of authority and responsibility. At no times will a SimMiles Staff member of Volunteer abuse such rights and/or privileges which may or may not be conferred upon them. At any time you feel a SimMiles Staff member or Volunteer is abusing such rights/privileges then you can contact the SimMiles CEO confidentially by email to andy@simmiles.com

Section 3: SimMiles Internal Review Process

1. The SimMiles Internal Review process is a process that is limited to the SimMiles Staff and Volunteers. Or those who are suitably recognised as competent in the safe keeping of the integrity of both the SimMiles community and its operations.
2. Internal reviews are used as a way of deciding the outcome of any complaint which may have arisen by an individual against a Virtual Airline or SimMiles itself.
3. Any grievance made must clearly show evidence of any infraction made and state the particular infraction and how it has caused a complaint to be made and what impact it is having or may have in the future. The more information and clarity provided will better help the review committee make any decisions. Before any decision is made the opposing party shall have the opportunity to state their case and bring up any raised points. Internal Reviews shall last no less than a period of 7 days, which is the time a “defendant” has to respond to such complaints. It is recommended that as many references can be made as possible, in particular to these terms too.
Section 4: Possible Penalties Which May Be Imposed
1. Possible penalties which can be imposed by the review committee where an individual is found to be guilty of any complaint raised can be one or more of the following; (Please note that further penalties may at some time be imposed if deemed necessary, and as such will be published below);

a. Fines of anything up to $10million in Virtual Funds.
b. Additional conditions imposed on the CEO and their Virtual Airline.
c. Additional real world charges invoiced to the CEO (in cases that it has caused financial loss as a result).
d. Removal of SimMiles membership without refund.
2. Please note that these decisions will not be made by 1 sole individual inclusive of the SimMiles CEO and executive team.
